FAA REISSUES POLICY ON AIRPORT RATES AND CHARGES

On September 10, 2013, the Federal Aviation Administration (FAA) republished its Policy Regarding Airport Rates and Charges (the “Policy”) in order to reflect the many amendments and deletions that had occurred since it was originally published on June 21, 1996.

In 1997, portions of the 1996 Policy were challenged and ultimately vacated by the U.S. Court of Appeals for the District of Columbia Circuit in Air Transport Ass’n of America v. DOT, 119 F.3d 38, amended by 129 F.3d 625 (D.C. Cir. 1997).

In 2008, the FAA proposed to allow aircraft operators to implement landing fee schemes that implemented congestion pricing principles.  The congestion pricing changes were challenged and upheld by Air Transport Ass’n v. DOT, 613 F.3d 206 (D.C. Cir. 2010).

Although there have been no recent changes in the Policy, the FAA agreed to republish because it had received many requests for a single document reflecting current official Policy.
